This Privacy Policy explains how Vision Made Co and its related entities may collect, hold, use and disclose your personal information.

By using our website and services, enquiring about or ordering our products and services, or otherwise giving us your personal information, you consent to us collecting, holding, using and disclosing it as described in this Privacy Policy. If we cannot handle your personal information in this way, we may not be able to provide our products or services to you or give you access to parts of our website.

Personal information

The Privacy Act defines ‘personal information’ as information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether or not the information or opinion is true.

Personal information we collect

The personal information we collect depends on how you deal with us. We may collect personal information about:

our clients and prospective clients, including founders, brand owners and their staff;
subscribers to The Vision Lab newsletter;
our suppliers, contract packers, freight providers, retail partners, referrers and other business contacts, and their staff;
current, prospective and former employees and contractors, including people who apply through our Careers page; and
other people who contact us or visit our website or facility.

The personal information we collect and hold may include your name, job title, company name, ABN, phone numbers, email address, street and postal addresses and other contact details. It may also include billing and payment details, order and delivery history, product ideas and brand information you share, communication preferences, call recordings or meeting notes, feedback, and other information that helps us run our business and comply with our legal obligations.

If you apply for a job with us, we may also collect your résumé, employment history, qualifications, referee details, right-to-work information and, where lawful and relevant, the results of background checks.

We may occasionally collect sensitive information. For example, we may collect health information relevant to workplace safety in a food and supplement manufacturing environment, or information about your membership of a professional or trade association. We will only collect sensitive information with your consent or where the law requires or allows it.

You can choose not to give us your personal information, but we may then be unable to respond to your enquiry, provide our products or services, or give you access to parts of our website.

How we collect and hold personal information

We collect personal information in different ways, including:

directly from you, for example when you complete the Book a Call, Formulate, Contact or Careers forms on our website, join The Vision Lab, email or phone us, meet with us, give us a business card, visit our facility, attend a trade show or event, place an order, or give feedback;
from someone acting for you, such as your employer, business partner, designer, broker or consultant;
from public sources, such as the Australian Business Register, ASIC, LinkedIn and company websites; and
from third parties who analyse traffic on our website and social media channels for us, which may involve cookies (see ‘Cookies and technology’ below).

We may collect personal information once, occasionally or on an ongoing basis from any of these sources. We may combine it with other personal information we already hold about you.

If we receive personal information about you from a third party, we will assume, and you must ensure, that you have told that third party that you referred us to them and why the information will be collected, used and disclosed.

We hold personal information in electronic form, in secure cloud-based systems such as our website platform, email, customer relationship management and accounting software, and sometimes in paper records at our premises.

Cookies and technology

When you visit our website, your browser may automatically give us non-personal information such as your IP address, approximate location, browser and device type, the pages you visit, the website you came from, and the date and time of your visit.

Our website uses cookies and similar technologies to operate properly, remember your preferences, understand how visitors use the site and measure the effectiveness of our marketing. Why we collect, hold, use and disclose personal information

We collect, hold, use and disclose your personal information for the main purposes for which we collected it, including to:

respond to your enquiry, book and hold discovery calls, and prepare quotes and proposals;
provide our services, including product development, ingredient and packaging sourcing, manufacturing, quality control, branding and design, regulatory support and dispatch;
confirm your identity and the identity of your business;
process orders, invoices and payments, and manage accounts;
manage our relationship with you, including providing support and telling you about products or services that may interest you;
send you The Vision Lab newsletter and other marketing communications;
understand your needs and how you use our website, so we can improve our services and website;
allow suppliers and service providers to help us deliver our products and services, including ingredient and packaging suppliers, testing laboratories, certification bodies (such as HASTA), designers, printers and freight carriers;
maintain batch records, traceability and quality systems, and manage product recalls;
organise events, trade shows and facility tours;
assess the suitability of job applicants and contractors; and
comply with our legal and regulatory obligations, including those relating to therapeutic goods, food safety, workplace health and safety, tax and record keeping.

We may also use and disclose your personal information for other purposes that you consent to, or that the law requires or allows. This includes a secondary purpose related to the main purpose for which we collected the information, where you would reasonably expect us to use or disclose it for that secondary purpose.

Disclosing personal information

For the purposes described in this Privacy Policy, we may disclose your personal information (including, in some circumstances, sensitive information) to:

our staff, related entities and contractors who need it to do their jobs;
suppliers and service providers who help us deliver our products and services, such as ingredient and packaging suppliers, contract packers, testing laboratories, certification bodies, designers, printers, warehouses and freight carriers;
our professional advisers, such as accountants, lawyers, auditors and insurers;
IT, website, hosting, data storage, email marketing, payment and debt collection providers;
regulators and government authorities, such as the Therapeutic Goods Administration, Food Standards Australia New Zealand, state food authorities and the Australian Taxation Office, where the law requires or allows it;
social media platforms where we have a presence;
anyone else you authorise us to disclose it to; and
anyone else the law requires or allows us to disclose it to.

We will not sell, rent or trade your personal information.

Overseas disclosure

Some of the service providers we use to run our business, including cloud hosting, email, website, analytics, email marketing and software providers, may store or process personal information outside Australia. We may also deal with overseas ingredient and packaging suppliers. Where this happens, we may disclose personal information to, or collect it from, overseas recipients to the extent needed for our business activities and functions, with your consent, or where the law allows it.

These recipients are likely to be located in the United States of America. They may also be located in other countries, such as members of the European Union, the United Kingdom, New Zealand and countries in Asia, depending on the supplier or service involved. We take reasonable steps to make sure that overseas recipients handle personal information in a way that is consistent with the Australian Privacy Principles.

Protecting personal information

We take reasonable steps to protect your personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps include:

using reputable cloud providers with secure data centres;
using password protection, multi-factor authentication and access controls;
limiting access to people who need the information;
keeping paper records and our premises physically secure;
training staff on privacy and confidentiality; and
securely destroying or de-identifying personal information when we no longer need it, unless the law requires us to keep it (for example, batch and manufacturing records).

If we have a data breach that is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner as required by the Notifiable Data Breaches scheme in the Privacy Act.

Anonymity and pseudonymity

Where practical, you may deal with us anonymously or using a pseudonym, for example when making a general enquiry. However, we will usually need your name and contact details to prepare a quote, supply products or services, or consider a job application. We may not be able to help you if you choose not to identify yourself.

Accessing and correcting personal information

Subject to the requirements and exceptions in the Privacy Act, you may ask to access or correct the personal information we hold about you by emailing sales@visionmadeco.com. There is no fee to make a request. We may charge a reasonable fee to cover our administrative costs of providing access. We will respond within a reasonable time, usually within 30 days. If we refuse your request, we will tell you why in writing.

Third-party content

Our website may include links to third-party content, including websites of retail partners, suppliers, certification bodies and social media platforms. We have no control over the privacy practices of these third parties and make no representations or warranties about them. Please read each third party’s privacy policy.

Marketing

We may use your personal information to tell you about our products and services, industry news, new product launches and events, including through The Vision Lab newsletter. We will only send commercial electronic messages in line with the Spam Act 2003 (Cth).

You can opt out of marketing at any time by clicking the unsubscribe link in any email or by contacting us at sales@visionmadeco.com. Even if you opt out of marketing, we may still send you service-related messages about your orders or account.
